Two employees with the same salary and length of service can receive different end-of-service benefits because their employers sit in different legal regimes. A free zone address is a starting point, but it does not identify the calculation by itself. Check the employing entity, governing employment rules and any approved savings arrangement before using a gratuity calculator.

Identify Your Employer and Employment Regime
Read the legal employer name on the employment contract and work permit. A company trading under an international brand may employ staff through different entities. Ask HR which legislation governs your employment and which authority handles employment complaints. An office location, client assignment or group headquarters should not be your only evidence.
For a non-financial free zone, check its employment guidance and whether the federal labour law applies to your arrangement. UAE and GCC nationals may instead have applicable pension obligations. This guide's gratuity examples assume eligible expatriate employees; pension-covered staff, contractors and unusual work patterns require their own checks.
Mainland and Other Federal-Law Employment
The UAE Government explains that eligible full-time expatriate workers qualify after one continuous year. Federal gratuity uses final basic pay, with 21 days for each of the first five years and 30 days for each subsequent year. Eligible fractions count proportionately, unpaid absence is excluded, and a two-year-wage ceiling applies.
Federal settlement obligations are generally due within 14 days after termination. These rules should not be copied automatically into an ADGM calculation. For employees enrolled in the approved alternative Savings Scheme, identify separately the period before enrolment and the subsequent contributions. Ask for the relevant agreement instead of assuming gratuity continues alongside every fund payment.
DIFC: Qualifying Schemes Rather Than Fresh Gratuity
DIFC introduced DEWS in February 2020, moving eligible employees to funded contributions through DEWS or another qualifying scheme. The published minimum employer rates are 5.83% of basic salary for service below five years and 8.33% for longer service, with the applicable rules governing the transition. Eligibility and exemptions must be checked individually.
If you worked for the same employer before the change, request the record of legacy gratuity and how it is being held or treated. A provider's current account balance alone may not describe every historic entitlement. For later service, reconcile employer contributions and the investment statement rather than multiplying all years by your final salary.
ADGM: Similar Day Counts, Different Calculation
ADGM's Employment Regulations 2024 took effect on 1 April 2025. Its official FAQ confirms gratuity after one continuous year, including termination for cause. The first five years use 21 days annually, then 30 days. The daily basis is annual basic wage divided by 365; the calculation's basic wage cannot be below 50% of annual wages.
The FAQ gives a 21-calendar-day payment deadline for wages and other termination amounts, excluding variable payments. ADGM also permits a pension or savings scheme option instead of gratuity. Ask to see the written arrangement and your election; do not assume DIFC's mandatory qualifying-scheme model governs an ADGM employer.
Worked Examples: Compare the Right Bases
Hypothetical federal example: an eligible full-time employee has final monthly basic pay of AED 6,000, three completed years and no excluded absence. Using a 30-day monthly basis, AED 6,000 divided by 30 multiplied by 21 multiplied by three gives AED 12,600. This is only the gratuity component, before any lawful deductions.
Separate hypothetical ADGM example: assume annual basic wage is AED 73,000, total annual wages AED 100,000 and three completed years. The basic wage already exceeds the 50% floor. AED 73,000 divided by 365 = AED 200 daily; multiplied by 21 and three gives AED 12,600. The equal answer is coincidental: the inputs and legal daily basis differ.
Separate DIFC contribution illustration: a covered employee below five years with AED 6,000 monthly basic salary has a sample monthly employer contribution of AED 349.80 at 5.83%. Twelve unchanged months total AED 4,197.60 contributed, before investment movements and charges. That is not a promised withdrawal balance or a three-year gratuity calculation.
Ask for a Settlement with Separate Lines
- Service: confirm employment dates, breaks, unpaid absence and any transfer between group entities.
- Pay: reconcile basic salary, allowances and the wage basis used for each entitlement.
- Benefit regime: request enrolment dates, fund statements and any preserved earlier gratuity record.
- Other amounts: list salary, leave, notice, expenses and deductions separately, with the reason for each deduction.
Do not assume every line uses the gratuity daily rate. Leave pay, notice and variable compensation can have different rules. Ask for the contract clause or statutory basis where HR's calculation differs from your estimate, and retain the calculation before signing an acknowledgement of receipt.
Use Calculators Within Their Scope
Our UAE gratuity calculator is useful for a federal-law estimate, not a substitute for an ADGM calculation or a DIFC fund statement. Read the gratuity calculation guide and basic salary versus allowances guide alongside your contract.
If the disagreement concerns missing contributions, first identify whether it is an employer-payment issue or a provider-account issue. Send the dates, payslips and relevant statement to the appropriate channel. Use the authority responsible for your employment regime rather than assuming a mainland complaint process covers every financial free zone.
