A UAE residence visa, freelance permit and tax registration describe different things. One allows residence, another authorises an activity, and a tax account records obligations under the relevant tax law. Before deciding that your freelance income is tax-free, identify whether clients contract with you personally or with a company you own.

Tax Residency Is a Separate Question
The UAE's domestic tax-residency rules include alternative tests. These cover usual or primary residence and the centre of financial and personal interests; physical presence of at least 183 days in a consecutive twelve-month period; or a qualifying 90-day presence route with additional nationality or permit and residence, employment or business conditions.
A residence visa alone does not establish every test, and the days need not align with a calendar tax year. Ministry of Finance guidance explains that parts of days count and a permanent home need not be owned, but must be continuously available. Retain travel and housing records instead of relying on a rough recollection of trips.
A Tax Residency Certificate and treaty eligibility also need their own assessment. Another country's rules can still matter. Do not assume a certificate automatically ends overseas tax residence or that the corporate tax definition of a Resident Person is identical to domestic residence tests used for other purposes.
Apply the Natural-Person Turnover Test
The FTA says a natural person is subject to corporate tax when conducting UAE business or business activities and total business turnover exceeds AED 1 million within January to December. Wages, qualifying personal investment income and qualifying real estate investment income are excluded from the business test. Their legal definitions matter.
Aggregate relevant business activities belonging to the same individual rather than checking each permit or client separately. Keep gross business revenue distinct from costs: a high-expense business can cross the turnover threshold despite having a small profit. Client location alone is not a safe shortcut for excluding receipts from your UAE business.
Registration and Tax Payable Are Different
FTA registration guidance gives a UAE-resident natural person who exceeds the threshold a registration deadline of 31 March in the following calendar year. Therefore, an individual crossing it in 2026 should check a 31 March 2027 registration deadline under that rule. Non-resident individuals with a UAE permanent establishment have a different timing rule.
The ordinary corporate tax rates are 0% on taxable income up to AED 375,000 and 9% above it. Taxable income follows the applicable accounting and tax adjustments; it is not necessarily the amount remaining in your bank account. Nil tax payable does not by itself remove registration, return or recordkeeping obligations.
Worked Example: Revenue Versus Taxable Income
Hypothetical ordinary-regime example: a UAE-resident individual earns AED 1,200,000 from relevant freelance business during 2026. Assume allowable expenses and all tax adjustments produce taxable income of AED 500,000. The turnover test is exceeded. Applying the ordinary rates gives (AED 500,000 minus AED 375,000) multiplied by 9% = AED 11,250.
This example assumes no relief, exemption, credits or special treatment. It does not verify that any particular expense is deductible. A laptop purchase, home-office expense or personal transfer should not be treated as a tax deduction merely because it appears on a business bank statement.
Separate hypothetical contrast: AED 800,000 of relevant annual business turnover does not exceed the natural-person AED 1 million entry threshold, even if expenses are low. That conclusion does not decide the VAT position, licence compliance or a separately incorporated company's obligations. Do not merge those tests into one limit.
Free Zone Individuals and Companies
The FTA's Free Zone Persons guide defines a Free Zone Person as a juridical person registered, incorporated or established in a free zone. It expressly excludes a natural person. An individual freelancer therefore cannot claim qualifying-free-zone-person status simply by holding a free zone permit or invoicing a free zone customer.
A separate free zone company needs its own corporate tax assessment and registration analysis. Qualifying status depends on conditions such as substance and qualifying income; it is not a blanket exemption for all receipts. The qualifying regime distinguishes qualifying income from taxable non-qualifying income. Ask an adviser to review the actual activities and counterparties.
Keep a File That Answers the Tax Questions
- Identity: retain the licence, legal-form documents, contracts and tax-account details.
- Revenue: reconcile invoices, credit notes, receipts and activity totals across the calendar year.
- Expenses: preserve supporting evidence and explain business purpose separately from private spending.
- Residency: keep entry and exit records, housing evidence and the facts supporting any certificate application.
Review your position before year end, particularly if a large invoice could take turnover over the limit. Put the registration deadline and later filing tasks in a calendar. Any relief should be checked against the relevant tax period and current eligibility; do not treat a temporary measure as permanent.
