A renewal message asking for more rent can feel urgent, especially when moving would mean another deposit and removal bill. In Dubai, start with the official rental index and your tenancy documents. An asking price in a nearby advert does not establish the increase permitted for your existing lease. Keep the amount, timing and evidence together before agreeing to a new figure.

Start with the Official RERA Rental Index Calculator
Dubai Land Department's Rental Index service asks for the tenancy expiry date, property type, area, room count and current annual rent. Access it through DLD's website or Dubai REST using the details requested by the current interface. Save the result and the inputs with a date. Enter annual rent rather than the value of one cheque.
DLD's Smart Rental Index uses building classification and property characteristics. Select the actual building and unit details rather than a nearby development with a similar name. If the property information is incorrect or the service cannot identify it, ask DLD how to correct or assess it. Do not substitute an estate agent's estimate for the official result.
Understand the Statutory Increase Bands
Decree No. 43 of 2013 sets renewal ceilings against the average rental value of similar units determined through the RERA-approved index. Its bands are reproduced below. Use the official calculator for the applied result, especially near a boundary; avoid inventing a rounding rule from a rough market estimate.
| Existing rent below the indexed average | Maximum increase |
|---|---|
| Up to 10% | 0% |
| 11% to 20% | 5% |
| 21% to 30% | 10% |
| 31% to 40% | 15% |
| More than 40% | 20% |
These are renewal rules. They do not mean a tenant taking a different apartment can demand the outgoing tenant's rent. Nor does the maximum require both parties to choose it: a lower negotiated increase remains possible. Ask for a written breakdown if the proposal mixes rent with parking, maintenance or other charges.
Check the Notice Period Separately
Article 14 of Dubai's tenancy law, as amended, provides for notification at least 90 days before expiry when either party wants to amend terms, unless otherwise agreed. Read your signed contract for any agreed variation. DLD's Smart Index guidance also explains that index eligibility alone does not cure missing advance notice.
Record when the proposal was received, who sent it, the lease end date and what it actually proposed. A general conversation about rising rents may not settle whether a particular amendment was notified. Keep the original email or message, including attachments and delivery information. Where timing or contractual wording is disputed, seek DLD or Rental Disputes Center guidance before signing.
Worked Example: An Illustrative Renewal Budget
Hypothetical figures, not a live index quotation: assume current annual rent is AED 80,000 and the official indexed average is AED 100,000. The shortfall is (100,000 minus 80,000) divided by 100,000, or 20%. The corresponding band permits a maximum 5% increase, subject to the applicable notice and tenancy requirements.
The increase would be AED 80,000 multiplied by 5% = AED 4,000, making annual rent AED 84,000. Its monthly budgeting equivalent is AED 7,000, compared with AED 6,666.67 previously: an extra AED 333.33 monthly. This arithmetic does not verify any particular unit's entitlement. If the calculator instead permits no increase, this sample cannot override it.
Do Not Confuse Renewal with Eviction
A rent-change notice and an eviction notice raise different legal questions. DLD identifies specific statutory eviction grounds and associated conditions. A demand to leave because you questioned an increase should not be treated as a complete explanation of those rules. Obtain advice on the stated ground, delivery method and notice period rather than assuming that the renewal deadline decides everything.
Keep paying attention to your existing obligations while a disagreement is unresolved. DLD describes an RDC Offer and Deposit procedure when a landlord refuses rent, subject to the prescribed process and judicial acceptance. Ask the authority about the correct route; simply keeping the money in your own bank account is not the same procedural step.
When negotiating, ask the landlord to confirm the agreed annual rent, cheque schedule and effective renewal date in one written response. Check that the replacement lease reflects that agreement before signing or issuing cheques.
Prepare a Useful Renewal File
- Tenancy evidence: retain the signed lease, Ejari, previous renewal and any agreed amendments.
- Index evidence: save the property details, enquiry date and complete result, including qualifications.
- Notice evidence: preserve the proposed amount and proof of receipt rather than only a cropped screenshot.
- Budget evidence: compare annual totals, cheque timing, moving costs and the cash needed for deposits.
DLD's FAQ says the Smart Index excludes DIFC, while the decree expressly includes DIFC in its scope. DIFC residents should confirm the appropriate local valuation and dispute procedure rather than assume the ordinary DLD lookup or RDC route applies unchanged. Other emirates also have their own tenancy frameworks.
